General Terms and Conditions of Nayomi

1.    General
Welcome to nayomi.com website (the "Site"). This Site is operated by Jamjoom Fashion Trading SPJSC, a company duly organized and existing under the laws of the Kingdom of Saudi Arabia, with commercial registration number (4030515435), and having its registered address at 7267 Prince Sultan, Zahran Business Centre, Al Salamah, 2634, Jeddah, Saudi Arabia (“Nayomi”, “we” and “us”).
All deliveries of Nayomi to the customer are based on the following general terms and conditions (the “Terms of Use”). These underlie all offers and agreements between Nayomi and the customer and are considered as accepted for the duration of the entire business relationship. Conflicting or deviating conditions of the buyer are only binding if Nayomi has accepted them in writing.

2.    Use of the site
You may only use this Site:
•    if you are at least 18 years of age or are using the Site under the supervision of your parent(s) or legal guardian; and
•    on your own behalf and not for any commercial purposes unless explicitly authorised by us in writing.
Any information you provide to us or submit to the Site for any registration or subscription purpose or otherwise must be accurate and current. You must promptly update such information if there are any changes. You are solely responsible for keeping passwords and other account identifiers safe and secure and you are entirely responsible for all activities including any spam or fraudulent act that occur under your password or account. You must notify us immediately of any unauthorized use of your password or account.

3.    User submissions
“Nayomi” is our registered trademark. We are the owner or licensee of all registered and unregistered intellectual property rights in the Site and all content published on the Site (“Content”), the Site design, including, but not limited to, text, graphics, software, photos, video, music, sound, logos, trademarks, designs, and their selection and arrangement, and all software compilations, underlying source code and software. You may download and print off one copy of extracts of our Site for personal use. You are not allowed to use our intellectual property, including but not limited to, patents, designs, photos, logos and trademarks for any other purpose whatsoever.

4.    No reliance on information
The Content is provided for information purposes only. Although we make a reasonable effort to ensure that the Content is accurate and up to date, we make no representation and provide no warranty and/or indemnification and/or compensation to this effect for whatsoever reason.

5.    Limitation of liability
To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms that may apply to the Site or its Content, whether express or implied. We will not be liable for any loss or damage or liability or compensation or indemnification (including indirect or consequential damage) suffered by you arising from your use of this Site. This includes, but is not limited to, losses arising from your use or inability to use the Site, reliance on any Content, infection by viruses, spams  or other technologically harmful materials affecting your computer equipment due to use of the Site, use of any website linked to this Site, and unauthorized or authorized use of your password or account.

6.    Disputes
If any dispute, controversy or claim arises out of or in connection with these Terms and Conditions (a “Dispute”) the parties shall use all reasonable endeavours to resolve the matter amicably. If one party gives the other written notice that a Dispute has arisen (a “Dispute Notice”), the parties shall attempt to resolve the Dispute amicably within thirty (30) days of service of the Dispute Notice. Neither party shall resort to adjudication against the other under these Terms of Use until thirty (30) days after service of the Dispute Notice.
If the parties fail to reach a settlement within one (1) month, the Dispute shall finally be settled in accordance with claim or dispute arising out of or relating to these Terms and Conditions and governed by the jurisdiction and governing law of Saudi Arabia. You agree to submit to the exclusive jurisdiction of the courts of Jeddah in the event of a Dispute.

7.    Terms and Conditions of sale

(a) Application
The products listed on this Site (“Products”) are offered and sold to you pursuant to these terms and conditions of sale, as amended from time to time (“Terms of Sale”). We may solely and discretionary amend these Terms of Sale at any time and the version in force at the time that you make an order for Products (“Order) will be the terms that apply to the contract between us for such Order. Other terms and conditions that may apply to you are contained in our Terms of Use and our Privacy Policy. Definitions used in our Terms of Use are also applicable to these Terms of Sale. Please carefully read these Terms of Sale, the Terms of Use and the Privacy Policy before, and every time, you make an Order.

(b) Products
The images of the Products are for illustrative purposes only. Although we make reasonable efforts to display the colours and other aspects of our Products accurately, there may be variations. We are not responsible if the colours of the photos are not accurate to or not matching the Products that you have selected in your Order. 

(c) Orders
After an Order is place, we will send you an email and/or SMS confirming receipt. However, acceptance of your Order does not occur until you receive an email from us informing you that your Order has been dispatched. We cannot guarantee that all Products will always be available for purchase. If we are unable to fulfil an Order, we will inform you by email and, if you have paid for the Order, refund the amount paid. Refunds reflect within 10-14 days. 

(d) Prices
The price of a Product will be as quoted on our Site at the time you submit your Order. The price of a Product does not include the delivery charge. Although we take all reasonable care to ensure that our Products are correctly priced, there may be circumstances where the price is incorrect. If we discover an error, we may, at our discretion, either cancel the Order or contact you to give you the option to purchase the Product at the correct price or cancel the Order.

(e) Payment
We accept payment in the following methods:
•    Credit card (Visa/MasterCard)
•    Apple Pay
•    MADA card (Debit card) in Saudi Arabia only
•    Tabby in Saudi Arabia only
•    Cash on Delivery in Saudi Arabia only
Nayomi reserves the right to restrict the use of one or more payment methods based on the country, minimum order value, or maximum order value.
Please note that Nayomi does not collect your credit/debit card number or personal information when you make a payment. For questions regarding your transactions on our site, please consult your card-issuing bank for information.
Your payment details will be provided directly to our payment provider via a secure connection. You must retain a copy of your transaction records and our Terms of Sale, Terms of Use and Privacy Policy.
Payment will be made in the same currency displayed at checkout at the time of purchase.

(f) Delivery / Shipping
Delivery shall be conducted by a shipment service provider chosen by Nayomi. We do not sell or deliver to any countries if prohibited by KSA or UAE law or OFAC sanctions. Your Order may incur customs duties and taxes at its destination. 
A single order may be split into multiple shipments, depending on the availability of the item and/or weight limits for parcels. Multiple shipments/delivery may result in multiple postings to the cardholder’s monthly statement. We are not responsible for any delay relating directly or indirectly to the shipment/delivery of your Order. 

(g) Returns
Considering the intimate nature of our Products, and the required Health and Safety laws, Nayomi accepts the return of item(s), provided that it meets the following conditions:
•    The product is not underwear, this includes bras, panties, teddys;
•    The product is not beauty, including mists, fragrances, beauty gift sets, oils and gels, and any other product displayed in the Beauty category online;
•    The product is returned within (7) seven days of the date of delivery; 
•    Only orders placed through the Saudi Arabia website are eligible for returns. International returns are not accepted;
•    You may return the Product online or in-store at any one of our Nayomi stores in the KSA. For returns to store, a valid proof of purchase must be presented
•    For COD orders, please contact customer support to help you with the return. Refund usually takes from 10-14 working days for all COD orders post receiving them in our warehouse passing a successful quality check
•    The Product is undamaged, unopened, unused and in its original packaging, with swing tags
•    If the Product was purchased as part of a special multi-buy offer, all of the Products purchased as part of the multi-buy order must be returned at the same time
Refunds will be made by the original mode of payment or to your bank account, in case you paid cash on delivery. We do not refund delivery charges except where the Product is defective or is not the Product you ordered.
Please be aware that refunds to Mada cards processed more than 14 days after the original purchase may be delayed up to an additional 4 weeks due to the refund processing policy enforced by Mada and your issuing bank.
